At Luvier Diamonds, we believe fine jewellery should evolve with you.
Our Exchange, Buy-Back and Trade-Up Program gives eligible customers the opportunity to return qualifying Luvier Diamonds jewellery and receive an assessed value that can either be paid as a Buy-Back amount or applied toward a qualifying new purchase.
This program is a voluntary customer benefit offered by Luvier Diamonds. It is separate from, and additional to, your statutory rights under the Australian Consumer Law.
1. Australian Consumer Law
The Luvier Diamonds Exchange, Buy-Back and Trade-Up Program is in addition to, and does not replace, limit, exclude or affect, any rights or remedies you may have under the Australian Consumer Law or any other applicable law.
Your statutory rights under the Australian Consumer Law apply independently of this program.
You do not need to participate in, or rely upon, this program to exercise any rights or remedies available to you under Australian law.
Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Where a customer's statutory rights apply, those rights will be dealt with separately from any Buy-Back, Exchange or Trade-Up benefit available under this program.
2. DefinitionsΒ
For these Terms and Conditions:
"Luvier Diamonds", "we", "us" or "our"
Means Luvier Diamonds and the relevant entity operating the Luvier Diamonds business.
"Customer", "you" or "your"
Means the person recorded as the original purchaser of an Eligible Item in Luvier Diamonds' sales records.
"Eligible Item"
Means jewellery originally purchased directly from Luvier Diamonds that satisfies all applicable eligibility, ownership, authenticity, condition and other requirements in these Terms and Conditions.
"Purchase Date"
Means the date shown on Luvier Diamonds' original sales invoice for the relevant Eligible Item.
"Original Purchase Value"
Means the final purchase price actually paid to Luvier Diamonds for the Eligible Item, excluding GST, after deducting discounts, promotional reductions, rebates, vouchers, credits, gift cards, trade-in credits and other reductions applied to the purchase.
The Original Purchase Value does not include:
- GST;
- delivery or shipping charges;
- insurance;
- finance charges or interest;
- payment-processing fees;
- valuation or certification fees;
- alteration or repair charges paid after the original purchase;
- amounts paid for unrelated goods or services;
- complimentary products;
- promotional products supplied at no additional charge; or
- any other amount that does not form part of the net purchase price of the Eligible Item.
Where an invoice contains multiple items and does not separately identify the purchase price of each item, Luvier Diamonds may allocate the total purchase price between the items using its transaction records and the pricing applicable to the items at the time of purchase.
"Assessed Market Value"
Means the current value of the Eligible Item determined by Luvier Diamonds at the time of assessment, taking into account the valuation factors set out in these Terms and Conditions.
"Eligible Credit"
Means the amount available under the program after applying the applicable program percentage and any relevant valuation, condition or eligibility adjustments.
"Trade-Up Bonus"
Means the additional 10% benefit that may be applied to an Eligible Credit when the customer completes an eligible Trade-Up.
3. How the Program Works
Subject to these Terms and Conditions, an eligible customer may:
Buy-Back - Return an Eligible Item to Luvier Diamonds and receive the applicable Buy-Back amount.
Exchange - Return an Eligible Item and apply the Eligible Credit toward another qualifying Luvier Diamonds purchase.
Trade-Up - Return an Eligible Item, apply the Eligible Credit toward a qualifying new Luvier Diamonds purchase and receive an additional 10% Trade-Up Bonus, subject to the requirements of these Terms and Conditions.
The availability of each option is subject to eligibility, assessment and the applicable requirements at the time of the transaction.
4. Program Eligibility
The program applies only to qualifying items that:
- were originally purchased directly from Luvier Diamonds;
- were purchased by an end consumer for personal use;
- can be verified against Luvier Diamonds' transaction records;
- are presented by the original purchaser, unless an ownership transfer has been formally approved by Luvier Diamonds;
- satisfy the applicable condition requirements;
- have not been lost, stolen or destroyed;
- can be authenticated and identified;
- have not been materially altered, modified or reconstructed in a manner that affects their identity, authenticity, condition or value; and
- satisfy any product-specific requirements applicable to that item.
The program does not automatically apply to every product sold by Luvier Diamonds.
Certain products or categories may be excluded from the program or may be subject to specific terms disclosed at or before purchase.
5. Original Purchaser and Proof of Ownership
Program benefits are personal to the original purchaser recorded in Luvier Diamonds' sales records.
Before processing a Buy-Back, Exchange or Trade-Up, Luvier Diamonds may reasonably require information necessary to verify the transaction and ownership, including:
- the original purchase receipt or invoice;
- government-issued photographic identification;
- the purchaser's name and contact details;
- proof of payment;
- evidence of ownership;
- the original laboratory report or certificate, where applicable;
- photographs or other identifying information; and
- any other information reasonably required to verify the transaction, ownership or authenticity of the item.
Missing Receipt
The absence of the original receipt does not automatically prevent a customer from participating where Luvier Diamonds can independently verify the original transaction through its records.
However, where Luvier Diamonds cannot reasonably verify that the item was originally purchased from Luvier Diamonds, the item will not qualify for the voluntary program.
Possession of an item, certificate, packaging or receipt does not, by itself, establish ownership or eligibility.
6. Transfer of Ownership
Program benefits are personal to the original purchaser and do not automatically transfer with ownership of the jewellery.
If an Eligible Item is gifted, sold, transferred or otherwise passed to another person, the new owner does not automatically acquire the original purchaser's program benefits.
Luvier Diamonds may approve a formal transfer of program eligibility at its discretion.
Any approved transfer must be recorded in Luvier Diamonds' records before the new owner seeks to use the program.
A private agreement between the original purchaser and another person does not, by itself, transfer program eligibility.
7. Commercial Purchases and Resale
The program is intended for end consumers purchasing jewellery for personal use.
Unless expressly agreed in writing, the program does not apply to:
- wholesalers;
- retailers;
- dealers;
- commercial resellers;
- purchases made primarily for resale;
- commercial inventory;
- or purchases made for business or commercial purposes.
Luvier Diamonds may require reasonable information to determine whether a purchase was made for personal use or primarily for resale.
8. Excluded Items
Unless expressly confirmed in writing by Luvier Diamonds, the following are excluded:
- jewellery not originally purchased directly from Luvier Diamonds;
- items acquired through unauthorised third-party channels;
- complimentary items;
- promotional items supplied at no additional charge;
- loose stones that were not purchased as part of an eligible Luvier Diamonds jewellery purchase;
- items supplied solely for display, photography or promotional purposes;
- items that have been reported lost or stolen;
- items that cannot be authenticated or reasonably verified;

and products specifically identified by Luvier Diamonds as excluded from the program.
9. Bespoke, Custom and Personalised Jewellery
Bespoke, made-to-order, custom-designed, engraved, personalised or substantially modified jewellery may be excluded from the program.
Where Luvier Diamonds agrees to include a bespoke or custom item, specific Buy-Back, Exchange or Trade-Up conditions may apply.
Any specific conditions applicable to the item will be communicated at or before purchase where reasonably practicable.
10. Buy-Back Percentage
Subject to these Terms and Conditions, Eligible Items may qualify for a Buy-Back after six (6) months from the Purchase Date.

The applicable percentage is calculated against the Original Purchase Value, not the original advertised retail price.
The percentages above represent the maximum program percentage and do not constitute an unconditional guarantee of the amount payable.
11. How the Buy-Back Amount Is Calculated
The Buy-Back Amount is determined using the following calculation:
Step 1: Determine Original Purchase Value
The Original Purchase Value is calculated in accordance with section 2.
Step 2: Apply the Applicable Program Percentage
The applicable percentage is determined by the time elapsed since the Purchase Date.
Step 3: Determine Assessed Market Value
Luvier Diamonds assesses the current market value of the Eligible Item at the time it is presented.
Step 4: Determine the Eligible Credit
The Eligible Credit will generally be the lower of:
- the applicable Program Percentage multiplied by the Original Purchase Value; or
- the Assessed Market Value,
subject to any applicable condition, authenticity, completeness or other adjustment under these Terms and Conditions.
Example
If the Original Purchase Value is $10,000 and the applicable Program Percentage is 70%:
70% Γ $10,000 = $7,000
If the Assessed Market Value is $8,000, the Eligible Credit is $7,000.
If the Assessed Market Value is $5,000, the Eligible Credit is $5,000.
The customer will be informed of the final Eligible Credit before the transaction is completed.
12. Assessed Market Value
The Assessed Market Value is determined at the time the jewellery is presented for assessment.
Luvier Diamonds may consider relevant commercial and physical factors including:
- current market prices for comparable lab-grown diamonds;
- the diamond's characteristics;
- current precious metal prices;
- the item's condition;
- design;
- current demand;
- whether the design remains commercially relevant;
- availability of comparable products;
- resale demand;
- missing or damaged components;
- alterations or modifications;
- refurbishment requirements;
- and other relevant market factors.
- The Assessed Market Value is not necessarily the same as:
- the original retail price;
- the amount originally paid;
- the replacement value for insurance purposes;
- the value shown on a laboratory report;
- the current retail price of a similar new item;

or the price at which the customer believes the item could be sold privately.
13. No Guaranteed Resale Percentage
The program does not guarantee that jewellery will retain a particular percentage of its original retail price or purchase price.
The stated 50%, 60% and 70% figures are maximum program percentages and are subject to the calculation and assessment process described in these Terms and Conditions.
Changes in lab-grown diamond prices, precious metal prices, market demand, design trends and resale conditions may affect the Assessed Market Value.
14. Condition Requirements
An Eligible Item must be in reasonably good, resalable condition and must remain structurally sound and authentic.
Normal signs of reasonable wear will not automatically make an item ineligible.
However, Luvier Diamonds may reduce the Eligible Credit or determine that an item is not eligible where its condition materially affects its appearance, structural integrity, authenticity or resale value.
Examples of conditions that may result in a reduced value or exclusion include:
- significant scratches or gouges;
- dents;
- chips or damage to diamonds or gemstones;
- broken or damaged settings;
- loose, missing or damaged stones;
- bent or deformed components;
- significant metal loss;
- significant discolouration;
- missing components;
- damage caused by misuse;
- evidence of unauthorised repair;
- or other material damage.
The existence of repairable damage does not require Luvier Diamonds to accept the item at its otherwise applicable maximum program value.
15. Condition Assessment Categories
For assessment purposes, Luvier Diamonds may classify an item as:
Category A - Normal Wear
The item has ordinary signs of wear but remains structurally sound and reasonably resalable.
Category B - Wear Requiring Refurbishment
The item remains eligible but requires cleaning, polishing, repair or refurbishment that materially affects its resale value.
Luvier Diamonds may take the reasonable cost and commercial impact of such work into account when determining the Eligible Credit.
Category C - Material Damage or Alteration
The item has damage, alteration or other issues that materially affect its identity, authenticity, structural integrity or resale value.
The item may be declined or assigned a materially reduced Eligible Credit.
16. Repairs, Resizing and Alterations
Customers must disclose any repair, resizing, engraving, remodelling, resetting, stone replacement, stone removal, metal alteration or other modification performed by a person other than Luvier Diamonds.
Unauthorised third-party work may affect eligibility and valuation where it affects the item's identity, authenticity, condition, structural integrity or resale value.
Repairs or alterations performed or authorised by Luvier Diamonds will not, solely for that reason, prejudice eligibility.
Luvier Diamonds may require evidence of third-party repairs or alterations where reasonably necessary to assess the item.
17. Certificates and Diamond Identification
Where an Eligible Item was originally supplied with a laboratory report, certificate or other identifying documentation, the customer should provide that documentation when presenting the item.
Luvier Diamonds may require verification where reasonably necessary to confirm:
- identity;
- authenticity;
- laboratory report details;
- carat weight;
- dimensions;
- treatment;
- origin, where applicable;
- or other relevant characteristics.
If the certificate cannot be matched to the item, is inconsistent with the item, or the item's identity or characteristics cannot otherwise be satisfactorily verified, Luvier Diamonds may defer assessment until verification is completed.
Luvier Diamonds may require independent testing where reasonably necessary to verify an item's identity or characteristics.
18. Missing or Inconsistent Documentation
Missing original packaging does not, by itself, make an item ineligible.
However, missing, inconsistent or unverifiable documentation may require additional verification and may affect the assessment where it materially affects authenticity, identification or resale value.
Luvier Diamonds may consider missing components, certificates or documentation when determining the item's Assessed Market Value.
19. Assessment Process
All Buy-Back, Exchange and Trade-Up requests are subject to assessment.
The assessment may require physical inspection.
A preliminary estimate, online estimate, telephone estimate, verbal indication or informal discussion is not a final offer.
The final Eligible Credit is determined after Luvier Diamonds has completed its assessment.
The customer will be informed of the applicable Eligible Credit before completing the transaction.
Submission of an item for assessment does not obligate Luvier Diamonds to complete a Buy-Back, Exchange or Trade-Up.
20. Exchange
An Exchange allows a customer to return an Eligible Item and apply its Eligible Credit toward another qualifying Luvier Diamonds purchase.
Unless otherwise agreed:
- the new purchase must have a purchase price greater than the Eligible Credit being applied;
- the Eligible Credit cannot be converted into cash;
- any unused Eligible Credit is not payable as cash;
- the Eligible Credit cannot be transferred to another customer;

and the Eligible Credit cannot be applied retrospectively to an earlier purchase.
If the customer wishes to receive cash instead of applying the Eligible Credit to another purchase, the transaction must qualify as a Buy-Back.
21. Trade-Up Benefit
A qualifying Trade-Up may receive an additional 10% Trade-Up Bonus.
The Trade-Up Bonus is calculated only on the final Eligible Credit determined after all applicable valuation, condition and eligibility assessments.
Formula
Eligible Credit Γ 10% = Trade-Up Bonus
Example
If:
-
Eligible Credit = $5,000
then:
- Trade-Up Bonus = $500
- Total Trade-Up Credit = $5,500
The 10% Trade-Up Bonus is not calculated on the original purchase price unless that amount is also the final Eligible Credit.
22. Trade-Up Requirements
A Trade-Up must involve a genuine new purchase from Luvier Diamonds.
Unless otherwise expressly agreed:
- the new purchase must have a purchase price greater than the total Trade-Up Credit being applied;
- the Trade-Up Bonus cannot be redeemed for cash;
- the Trade-Up Bonus cannot be transferred;
- the Trade-Up Bonus cannot be sold;
- the Trade-Up Bonus cannot be applied retrospectively;
- the Trade-Up Bonus cannot be applied to a previous purchase;
- the Trade-Up Bonus cannot be separated from the qualifying Trade-Up transaction; and
- the customer cannot receive cash for any unused Trade-Up Credit.
Luvier Diamonds may identify particular products or categories that are not eligible for Trade-Up.
23. Promotions and Discount Stacking
Trade-Up Credit cannot be combined with another discount, promotional offer, voucher, rebate, store credit or special pricing arrangement unless the relevant promotion expressly permits such combination.
Where a new purchase is subject to a promotion, Luvier Diamonds may specify whether the Trade-Up benefit or promotional benefit applies.
The customer will be informed of the applicable purchase price and benefits before the transaction is completed.
24. Deposits and Partially Paid Purchases
The Original Purchase Value is based on the final purchase price of the Eligible Item once the item has been paid for in full.
A deposit, instalment or partial payment does not, by itself, establish a separate Original Purchase Value.
Where a purchase has not been paid in full, the item is not eligible for the voluntary Buy-Back, Exchange or Trade-Up program until the original purchase has been completed and recorded as fully paid, unless Luvier Diamonds expressly agrees otherwise.
25. Finance and Payment Methods
The Original Purchase Value is based on the purchase price of the jewellery, regardless of the payment method used.
Interest, finance charges, account fees and other charges imposed by third-party finance providers are not included in the Original Purchase Value.
26. Multiple Items and Sets
Where multiple jewellery items were purchased in a single transaction, each item will ordinarily be assessed separately.
Where items were sold as a single inseparable set or product, Luvier Diamonds may assess the set as a whole.
A customer cannot divide, combine, restructure or otherwise present items in a manner designed to increase the Eligible Credit.
Where only part of a set is presented, Luvier Diamonds may:
- assess the individual item separately;
- apply an adjustment for the incomplete set; or
- determine that the item is not eligible,
depending on the circumstances and the effect on resale value.
27. Discounts, Vouchers and Promotional Benefits
The Original Purchase Value reflects the amount actually attributable to the Eligible Item after applicable discounts and reductions.
For example, if an item has an advertised price of $10,000 but the customer receives a $2,000 discount and pays $8,000 excluding GST, the Original Purchase Value is $8,000.
Complimentary items supplied at no additional charge do not create Buy-Back or Trade-Up value.
Where a promotion provides a combination of discounts, vouchers, store credits, rebates or complimentary products, Luvier Diamonds may determine the portion of the transaction attributable to the Eligible Item using its transaction records and the terms of the relevant promotion.
28. One Trade-Up Bonus Per Item
Each item may receive the enhanced 10% Trade-Up Bonus only once.
Luvier Diamonds will maintain transaction records for Eligible Items used in the program.
Once an item has been used in a Trade-Up transaction, that item's previous purchase value and previous Trade-Up history cannot be used to generate another Trade-Up Bonus.
Where an item acquired through a previous Trade-Up is later presented under the program, its eligibility and value will be determined by reference to its most recent qualifying purchase transaction, subject to the following section.
29. Jewellery Acquired Through a Trade-Up
Where a customer acquires jewellery through a Trade-Up and later seeks to return that jewellery under the program:
- the item will be assessed based on its most recent qualifying Luvier Diamonds purchase;
- its current condition and Assessed Market Value will be considered;
- previous Trade-Up credits relating to the item cannot be counted again;
- and a previous Trade-Up Bonus cannot be carried forward or reapplied.
An item cannot generate a new Trade-Up Bonus merely by being repeatedly returned and repurchased through the program.
Luvier Diamonds may refuse a transaction where its primary purpose appears to be the artificial creation or accumulation of program benefits.
30. No Double Counting or Stacking
Unless expressly stated otherwise, the same item or transaction cannot generate more than one of the same program benefit.
This includes:
- multiple Trade-Up Bonuses;
- duplicate Buy-Back claims;
- duplicate Exchange credits;
- multiple promotional credits;
- or any other benefit that would result in the same value being counted more than once.
Luvier Diamonds will not recognise an arrangement designed to split, combine or restructure transactions for the purpose of increasing program benefits.
31. Lost, Stolen or Destroyed Jewellery
The voluntary program does not provide Buy-Back, Exchange or Trade-Up value for jewellery that has been lost, stolen or destroyed.
A police report, insurance claim, photograph, certificate or other documentation does not, by itself, make a lost, stolen or destroyed item eligible for this voluntary program.
This provision does not affect any rights the customer may have under applicable law or under a separate insurance policy.
32. Fraud, Misrepresentation and Program Abuse
Luvier Diamonds may pause or decline a program transaction where it reasonably suspects:
- fraud;
- theft;
- false or misleading information;
- unauthorised ownership transfer;
- manipulation of purchase records;
- substitution of stones or components;
- duplicate claims;
- deliberate damage;
- artificial cycling of transactions;
- purchases made primarily for resale;
- or other misuse or attempted misuse of the program.
Luvier Diamonds may require additional verification before proceeding.
Nothing in this section limits any rights or obligations Luvier Diamonds may have under applicable law.
33. Buy-Back Payment
Where a Buy-Back is approved, the final Buy-Back amount will be confirmed with the customer before the transaction is completed.
Buy-Back payments will ordinarily be made by electronic bank transfer or another payment method agreed between Luvier Diamonds and the customer.
Luvier Diamonds may require reasonable verification of the customer's identity and payment details before releasing funds.
Where reasonably necessary for fraud prevention or transaction verification, Luvier Diamonds may require payment to be made to the original purchaser.
Once a Buy-Back transaction has been completed and the item has been accepted by Luvier Diamonds, the transaction is final, subject to any rights that cannot lawfully be excluded.
34. Trade-Up Credit Is Not Cash
Trade-Up Credit and the Trade-Up Bonus are purchase credits only.
They:
- cannot be redeemed for cash;
- cannot be transferred;
- cannot be sold;
- cannot be exchanged for cash;
- cannot be applied retrospectively;
- cannot be used for an earlier purchase; and
- cannot be redeemed independently of a qualifying Trade-Up.
Any unused portion of Trade-Up Credit will not be paid to the customer as cash.
35. Ownership of Jewellery Following Buy-Back
When a Buy-Back transaction is completed, the customer transfers the jewellery to Luvier Diamonds and receives the agreed Buy-Back amount.
The customer must not subsequently seek to reclaim, exchange or trade the item under the program once the Buy-Back transaction has been completed, except where required by applicable law.
36. No Automatic Approval
Submitting an item for assessment does not guarantee:
- acceptance into the program;
- a Buy-Back;
- an Exchange;
- a Trade-Up;
- a particular valuation;
- the 10% Trade-Up Bonus;
- or any particular payment amount.
Each request is assessed against the applicable program terms at the time the transaction is requested.
37. Program Records
Luvier Diamonds may maintain records of:
- original purchase details;
- item identification;
- certificates and laboratory reports;
- ownership;
- previous Buy-Back transactions;
- previous Exchange transactions;
- previous Trade-Up transactions;
- Trade-Up Bonuses previously applied;
- and other information reasonably required to administer the program and prevent duplicate or fraudulent claims.
These records may be used to determine an item's program history and eligibility.
38. Program Changes
Luvier Diamonds may amend, suspend or discontinue this voluntary program for future purchases or future program transactions where reasonably necessary, including due to:
- changes in market conditions;
- changes in lab-grown diamond pricing;
- changes in precious metal pricing;
- product availability;
- changes in business circumstances;
- fraud or misuse;
- regulatory requirements;
- or the commercial sustainability of the program.
Any changes will apply prospectively and will not retrospectively remove a benefit that has already been validly earned, assessed and confirmed, subject to applicable law.
Luvier Diamonds will not represent that the program will necessarily remain available indefinitely.
39. Customer Responsibilities
Customers are responsible for:
- retaining purchase documentation;
- taking reasonable care of their jewellery;
- disclosing alterations and repairs;
- providing accurate information;
- presenting the correct item for assessment;
- providing documentation reasonably requested for verification;
- and complying with these Terms and Conditions.
40. How to Make a Request
To begin a Buy-Back, Exchange or Trade-Up request:
- Contact the Luvier Diamonds Customer Care Team at care@luvierdiamonds.com.
- Provide your original purchase details.
- Provide any documentation reasonably requested.
- Follow the instructions provided by the Customer Care Team.
- Arrange a physical inspection where required.
- Present the Eligible Item for assessment.
- Luvier Diamonds will determine eligibility and the applicable Eligible Credit.
- Luvier Diamonds will communicate the applicable value and transaction terms before the transaction is completed.
- If you accept the applicable terms, the Buy-Back, Exchange or Trade-Up transaction will be processed.
41. Assessment Outcome
The assessment outcome may take into account:
- the original transaction;
- purchase date;
- ownership;
- authenticity;
- certificates and documentation;
- condition;
- alterations and repairs;
- completeness;
- current market conditions;
- current resale demand;
- and other relevant valuation factors described in these Terms and Conditions.
The final Eligible Credit communicated to the customer represents Luvier Diamonds' assessment under the program at that time.
The customer may choose whether or not to proceed with the voluntary program transaction after being informed of the applicable value.
42. Important Information
This program is designed to provide customers with an additional benefit when purchasing and continuing to own Luvier Diamonds jewellery.
The program is not an investment product, financial product or guarantee of future jewellery value.
Lab-grown diamond prices, precious metal prices, jewellery designs and market demand may change over time.
The program should therefore not be represented as a guarantee that a customer will recover a particular percentage of the amount originally paid.
